Three Degrees of Felony Assault
There are three types of felony assault in Washington State, all of which carry potentially severe penalties. Our firm can help defend you against any one of the following felony assault charges.
Third Degree Assault – You will be charged with this Class C felony if you meet one of the following conditions:
- Assaulted a doctor, law enforcement officer, firefighter, or other protected party
- Committed the assault to avoid arrest or violate a court order
- Through your negligence, used a weapon to cause bodily harm
Second Degree Assault – This is a Class B felony, carrying up to a year behind bars if you have no prior convictions. There are a number of conditions which can lead to a 2nd degree assault charge, including:
- Poisoned or strangled someone
- Intentionally caused substantial bodily harm
- Used a deadly weapon in the assault
- Harmed an unborn child by assaulting the mother
First Degree Assault – This Class A felony is the most serious type of assault, and a conviction could lead to more than 10 years in jail. For 1st degree assault to have occurred, you must have intentionally committed the assault with a gun or other deadly weapon, in a way that likely would kill or severely harmed the victim.
