What is needed to petition the court for a modification?
Washington's family courts are cautious when it comes to modifying court orders after a divorce, especially if the established arrangements have been in place for a considerable amount of time. The courts are always operating in the best interests of minor children and they often presume that children need a sense of regularity when, for example, it comes to being in the custody of their parents.
For this reason, the courts will require substantial proof that a change or modification to an existing child custody or support arrangement must be made. Once the court approves the modification, the new plan will officially become a legally binding court order.
Evidence that courts consider when evaluating petitions for modifications include:
